Setting up a charity in the UK, it is important to be aware that (in its most common form) a charity will be governed by both Company Law and Charity Law. The most common way to set up a charity is to form a company limited by guarantee. Drafting the company articles in just the right way (to include various clauses; charitable objects clause, non–profit distribution clause etc) means that the company will meet the legal requirements placed on it in order to carry out a legally proper set up.

Setting up a charity in this way means that you will be required to carry out a company formation with Companies House and register the company as a charity with the Charity Commission.
