You can use your trade mark as security for a loan. The lender will have a legal right in your trade mark until you have repaid the loan, but you will still be able to use your trade mark.

You would break the law (Section 95 of the Trade Marks Act 1994) if you use the registered symbol ® or the abbreviation "RTM", on a mark that is not registered anywhere in the world.

Trade marks or are symbols that distinguish goods and services in the marketplace (like brand names and logos). A trade mark may consist of words, logos or a combination of both.

If you register a trade mark it gives you the exclusive right to use your mark for the goods and/or services that it covers in the United Kingdom (UK).

Trademark Registered symbol (R)When you apply for a trade mark you need to list the goods and/or services on which you intend to use your trade mark:

  • Goods are in classes 1 to 34.
  • Services are in classes 35 to 45.

If you have a registered trade mark you can put the ® symbol next to it to warn others against using it.

A registered trade mark:

  • may put people off using your trade mark without your permission;
  • allows you to take legal action against anyone who uses your trade mark without your permission;
  • allows Trading Standards Officers or Police to bring criminal charges against counterfeiters if they use your trade mark;
  • is your property, which means you can sell it, use it as security for a loan, or sell other people a licence that allows them to use your trade mark;

Even if a trade mark already exists in one classification, you may still be able to register a trademark in another unrelated class. Think about “POLO”. This is registered as a trademark in class 30 by Nestle for who make the well know mints and in class 12 by Volkswagen who produce the car of the same name.

Registering a company name with Companies House does not mean that you have a trade mark. Trade mark applications must be made separately.
